Welcome to From Head to Toe Academy.

These Terms & Conditions (“Terms”) govern your use of the From Head to Toe Academy website, membership platform, digital content, programs, workshops and related services (collectively, the “Services”).

By creating an account, purchasing a membership or service, or otherwise using the Services, you agree to these Terms.

If you are purchasing or registering on behalf of a child, you confirm that you are the child’s parent or legal guardian, or that you have authority from the parent or legal guardian to do so.

1. About From Head to Toe Academy

From Head to Toe Academy provides educational resources and services designed to support Irish dancers in areas including strength and conditioning, mobility, performance preparation, nutrition education, performance psychology, mindfulness, recovery and dancer wellness.

The Academy may offer services including:

  • online membership access
  • on-demand video content
  • live and recorded workshops
  • strength and conditioning programs
  • educational courses and resources
  • individual coaching or consultations
  • school or group programs
  • Elevate Irish Dance Strength & Conditioning programs
  • Elevate Juniors programs
  • other dancer wellness and performance services

Specific programs or services may have additional terms, requirements or registration information provided at the time of purchase.

2. Educational Nature of Our Services

From Head to Toe Academy provides educational and general wellness information.

Our content and services are not intended to diagnose, treat, cure or prevent any medical, psychological or health condition and should not be used as a substitute for individualized care from an appropriately qualified healthcare professional.

Different members of the From Head to Toe Academy team work within their own professional qualifications and scopes of practice.

3. Memberships

Academy memberships provide access to the content and features included within the membership level purchased.

Membership benefits and available content may change over time as the Academy updates, adds, replaces or removes resources.

We aim to continually develop and improve the Academy, but we do not guarantee that any particular video, class, coach, workshop, feature or resource will remain available indefinitely.

4. Recurring Billing

Monthly memberships automatically renew each billing period until cancelled.

By purchasing a recurring membership, you authorize the applicable payment provider to charge the payment method you provide at the stated membership rate and billing frequency until you cancel.

The membership price and billing frequency are displayed before purchase.

We reserve the right to change membership pricing in the future. Existing members will be given appropriate notice before a pricing change applies to a future renewal.

5. Cancelling a Membership

You may cancel your recurring Academy membership at any time.

Cancelling prevents the next scheduled renewal payment.

Unless otherwise stated, your membership access will remain available until the end of the billing period that you have already paid for. Your membership will then expire and you will no longer have access to member-only content.

Cancellation does not normally result in a prorated refund for the unused portion of a billing period.

6. Refunds

Membership payments are generally non-refundable once processed, including where a member chooses not to use the Academy during their paid membership period.

Where a separate workshop, coaching service, program or event has its own cancellation or refund policy, that policy will be provided during registration and will apply to that purchase.

Nothing in these Terms limits any refund or other rights that cannot legally be excluded under applicable law.

7. Failed Payments

If a recurring membership payment fails, we may attempt to process the payment again or contact you to update your payment information.

Access to membership content may be suspended or terminated if payment remains outstanding.

8. User Accounts

Where an account is required, you are responsible for:

  • providing accurate registration information
  • keeping your login information secure
  • maintaining the confidentiality of your password
  • ensuring that your account is used only as permitted under your membership

Please notify us if you believe your account has been accessed without authorization.

9. Account Sharing

Individual Academy memberships are intended for the registered member and their household only as specified at purchase and may not be shared with other dancers, families, schools, teachers or organizations unless the applicable membership expressly allows it.

Login information, videos, downloads and other member-only resources must not be distributed or shared outside the permitted membership.

Schools, teams and organizations wishing to provide access to multiple dancers should use an appropriate school, group or organizational membership where available.

We reserve the right to suspend or terminate accounts where we reasonably believe membership access is being shared or misused.

10. Children and Users Under 18

Many From Head to Toe Academy services are designed for dancers who are under 18.

A parent or legal guardian must complete or authorize registration and purchasing for a minor where required.

Children under 13 should not independently create an Academy account, submit personal information or make purchases through the website.

Where information relating to a child under 13 is required, it should be provided or authorized by the child’s parent or legal guardian in accordance with our Privacy Policy.

Parents and guardians are responsible for determining whether Academy activities and content are appropriate for their child.

11. Exercise and Physical Activity

Some Academy programs include exercise, strength and conditioning, mobility, stretching, warm-ups and other forms of physical activity.

Physical activity carries inherent risks, including the possibility of injury.

Participants should:

  • work within their own abilities
  • follow instructions carefully
  • use appropriate equipment and surroundings
  • stop an activity if they experience pain, dizziness, unusual shortness of breath or other concerning symptoms
  • seek appropriate medical advice where necessary before beginning or continuing an exercise program

Participation is voluntary.

12. Individual Differences

Every dancer is different.

Results from training, nutrition strategies, performance preparation, psychology techniques, mobility work or other Academy resources will vary between individuals.

We do not guarantee specific improvements in competition results, placement, strength, flexibility, performance, confidence, body composition, injury prevention or any other outcome.

13. Nutrition Content

Nutrition information provided through the Academy is educational in nature.

Where individualized nutrition services are provided by a registered dietitian or other appropriately qualified professional, the scope and terms of that individual service may be provided separately.

General Academy nutrition content should not be treated as individualized medical nutrition therapy or as a substitute for advice from your own healthcare provider.

14. Performance Psychology and Mental Performance Content

Performance psychology, mental performance, mindfulness and similar content provided through the Academy is intended to support performance education and skill development.

Unless expressly stated as part of a separately established professional service, Academy content does not constitute psychotherapy, mental health treatment, diagnosis or crisis care.

Anyone experiencing a mental health concern should seek support from an appropriately qualified healthcare or mental health professional.

15. Coaching and Individual Services

Certain coaches or professionals associated with the Academy may offer individual sessions, consultations or coaching.

Availability is not guaranteed.

Individual services may have separate pricing, scheduling, cancellation policies and professional terms that will be communicated when the service is booked.

16. Workshops, Events and Programs

From time to time, the Academy may offer live or virtual workshops, events, challenges, training cycles or other limited-duration programs.

Program-specific information, including dates, pricing, attendance requirements, cancellation terms and access periods, may be provided separately.

Where program-specific terms conflict with these general Terms, the terms provided for the specific program will apply to that program.

17. Recordings

Live online workshops, classes or educational sessions may sometimes be recorded and made available to participants or Academy members.

Where participant cameras, voices or contributions may be included in a recording, we will take reasonable steps to provide appropriate notice.

Additional consent may be requested where necessary, particularly when minors are involved.

18. Intellectual Property

Unless otherwise stated, the website and Academy materials are owned by or licensed to From Head to Toe Academy.

This includes, without limitation:

  • videos
  • workout programs
  • exercises and training materials
  • written resources
  • PDFs and downloads
  • worksheets
  • presentations
  • graphics
  • photographs
  • logos
  • course materials
  • workshop recordings
  • website copy
  • program structures and educational resources

Purchasing a membership or service gives you a limited, personal, non-transferable right to access and use the materials for their intended purpose.

It does not transfer ownership of those materials to you.

19. Prohibited Use of Academy Content

Without prior written permission, you may not:

  • copy or reproduce Academy materials for commercial use
  • upload Academy content to another website or platform
  • distribute Academy videos, recordings or downloads
  • share paid resources with non-members
  • resell Academy content
  • use Academy materials to create or market another paid program
  • record or redistribute member-only videos or workshops
  • remove copyright, branding or ownership notices

Reasonable personal use of materials specifically provided for downloading or printing is permitted.

20. Third-Party Services

The Academy uses third-party providers to operate parts of its website and services, which may include payment processors, email providers, membership systems, video platforms and other technology services.

Your use of those services may also be subject to the relevant provider’s terms and privacy practices.

21. Website Availability

We aim to keep the website, membership platform and digital resources available and functioning properly.

However, we cannot guarantee uninterrupted or error-free access at all times.

Access may occasionally be affected by:

  • maintenance
  • software updates
  • internet outages
  • third-party service interruptions
  • technical problems
  • circumstances outside our reasonable control

We will make reasonable efforts to resolve significant access issues.

22. Changes to Services

We may update, improve, reorganize or discontinue elements of the Academy or its Services from time to time.

This may include changes to:

  • coaches or contributors
  • videos and resources
  • program structure
  • website functionality
  • membership benefits
  • class or workshop schedules
  • pricing

Where a change materially affects an ongoing paid service, we will provide reasonable notice where appropriate.

23. Suspension or Termination of Access

We reserve the right to suspend or terminate access where a user:

  • fails to make required payments
  • shares or misuses membership access
  • unlawfully distributes Academy content
  • engages in fraudulent activity
  • seriously disrupts Academy services or communities
  • violates these Terms

Where appropriate, we will attempt to contact the account holder before terminating access.

24. Limitation of Liability

To the fullest extent permitted by applicable law, From Head to Toe Academy and its owners, coaches, contractors and contributors will not be liable for indirect, incidental, special or consequential losses arising from the use of the Services.

Nothing in these Terms is intended to exclude or limit liability where doing so would be prohibited by law.

Participants remain responsible for their own decisions regarding training, physical activity, healthcare and participation in dance.

25. Privacy

Your privacy is important to us.

Our collection and use of personal information is described in our Privacy Policy.

By using the Services, you acknowledge that you have had the opportunity to review the Privacy Policy.

26. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, business practices or applicable requirements.

The updated version will be posted on the website with a revised effective date.

Where a significant change materially affects an existing paid membership, we will provide reasonable notice where appropriate.

27. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, subject to any consumer protection laws or other rights that apply regardless of this provision.
